Abstract
This study reviewed and analyzed the different legislations penalizing or treating extrajudicial killings and other studies, researches, and related readings or literatures related to such, for at present there are a lot of unresolved killings in the call of the President for war on drugs thus this study was conducted to analyze such legislations and to determine the possibility of proposing legislations to better protect the rights of an Individual Violated by the extrajudicial killings under the present administration in the Philippines. For each person must be given the right to a hearing before being sentence to any penalty. Thus there must be laws or statutes that could better help protect and uphold the rights of an individual as enshrined in the Declaration of Human Rights and in the Philippine Constitution. The study Is a qualitative research study. Specifically, the researcher used the Integrative literature review, integrative literature review Is a form or a type of research that reviews, critiques, and synthesizes representative literature on a topic in an integrated way. in this study researcher used thirteen studies related to extrajudicial killings. There is a difficulty in penalizing extrajudicial killings for the crime of extrajudicial killing is not defined specifically and carefully in order to understand their differences from lawful exercise of strength and force and to distinguish their malicious and illiberal nature.
